Personal data will only be collected, used and passed on by AL-KO Vehicle Technology if this is permitted by law or if you demonstrably consent.
Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

We adhere to the principles for the processing of personal data in accordance with Art. 5 GDPR. Your data will be processed on the basis of lawfulness, fair processing, transparency

  • for the purposes of the processing, limited to what is necessary ("data minimisation")
  • factually accurate and, where necessary, kept up to date
  • only for as long as necessary for the purposes for which they are processed and
  • including an adequate guarantee for security of the personal data. 

If we use external service providers for the fulfilment of our business processes, they will receive personal data from us in accordance with Art. 28 GDPR data to the extent necessary. Please understand that we do not disclose the individual service providers automatically. However, your data protection rights are comprehensively guaranteed according to the specifications of the commissioned processing.

Al-KO Vehicle Technology takes extensive precautions to ensure the security of your personal data. In doing so, we are guided by ISO/IEC 27001 and have established technical and organisational measures to protect your data from loss of integrity, availability and confidentiality.

On the one hand, your data is collected by you providing it to us. This may be, for example, data that you enter in a contact form. Other data is collected automatically by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system or time of page view). If we wish to process your personal data for a purpose not previously mentioned, we will inform you in advance within the framework of the legal provisions.

  • Data processing for the purpose of initiating and processing a contract (Art. 6 (1) (b) GDPR)

Personal data beyond this, such as your name, address, telephone number or email address, are not collected when you visit the website; unless you provide this information voluntarily, e.g. to receive a contract offer. Your details will be stored for the purpose of processing your enquiry and dealing with it.

In order to provide this website and for the aforementioned purposes, your data may be passed on to technical service providers supporting us (e.g. website support providers), which we have carefully selected and with whom we have concluded an order processing agreement. Your data will otherwise only be passed on to other third parties and transferred to third countries if this is expressly stated in this data protection declaration or if we are legally required to do so.

We store your personal data for the above purposes. Your data will be processed for the first time from the time of collection, insofar as you or a third party provide it to us. We delete your personal data that you have provided to us when the contractual relationship with you is terminated or you revoke your consent and all mutual claims have been fulfilled and there are no other legal retention obligations or legal justification reasons for storage.
With Google Analytics, we use the option to limit the storage period for your data to 26 months.

With regard to the right to information and the right to deletion, the restrictions according to §§ 34 and 35 Federal Data Protection Act (BDSG) apply. 

 

Right to object 

If the processing of your personal data is carried out in accordance with Art. 6 (1) (e) or (f) GDPR, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation; if you object, we will no longer process your personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims (objection under Art. 21 (1) GDPR).

 

Right of revocation in case of consent 

If you have given us separate consent to data processing, you can revoke this consent in accordance with Art. 7 (3) GDPR at any time. Such revocation will not affect the lawfulness of the processing carried out on the basis of the consent up to the revocation.

 

Right to object to the collection of data in specific cases and to direct marketing (Art. 21 GDPR)

If we process personal data about you for the purpose of direct marketing, you may object to this processing in accordance with Art. 21 (2) and (3) GDPR. If you object, your personal data will subsequently no longer be processed for the purpose of direct marketing.

 

Right of appeal to the competent authority

When you visit our website, your surfing behaviour can be statistically analysed. This is done mainly with cookies and with so-called analysis programs. The provider of the pages automatically collects and stores information in so-called server log

This data is not merged with other data sources. The collection of this data is based on Art. 6 (1) (f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be recorded.


Contact form

If you send us enquiries through the contact form, your details from the enquiry form, including the contact details you provided there, will be temporarily stored by us for the purpose of processing the enquiry and in the event of follow-up enquiries. The processing of the data entered in the contact form is accordingly based exclusively on your consent (Art. 6 (1) (a) GDPR). When using our contact form, your data will be stored on our server. Product registration on this website

You can register a product on our site. The mandatory information requested during registration must be provided in full. Otherwise we will refuse the registration. For product registrations through our website, first name, surname, address, email address and telephone number are collected and stored. For important changes, for example in the scope of the offer or in the case of technically necessary changes, we use the email address provided during registration to inform you in this way. The processing of the data entered during registration is carried out for the fulfilment of the contract or for the implementation of pre-contractual measures (Art. 6 (1) (b) GDPR). Your personal data, to which you have consented as part of the product registration process, will also be stored by Jotform Inc, 111 Pine St Suite 1815, San Francisco, CA 94111, USA ("Jotform"). When using our contact form, your data is stored on the Jotform server. Conclusion of a contract for commissioned processing

We have concluded a contract for commissioned processing with Jotform and fully implement the strict requirements of the German data protection authorities when using Jotform.

Google Analytics

This website uses functions of the web analysis service Google Analytics. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files that are stored on your computer and enable an analysis of your use of the website. IP anonymisation

Google AdWords and Google Conversion Tracking

This website uses Google AdWords. AdWords is an online advertising programme of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google"). 
Within the scope of Google AdWords, we use the so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. Cookies are small text files that the web browser stores on the user's computer. These cookies lose their validity after 30 days and are not used to personally identify users. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognise that the user has clicked on the ad and been redirected to this page.
Each Google AdWords customer receives a different cookie. The cookies cannot be tracked through the websites of AdWords customers. Facebook Pixel

Our website uses the visitor action pixel from Facebook, Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") for conversion measurement.
In this way, the behaviour of page visitors can be tracked after they have been redirected to the provider's website by clicking on a Facebook ad. Data protection is very important to us. Therefore, we strictly adhere to legal provisions when collecting, processing and using your personal data. We collect, store and process your data for the entire processing of your purchase, including any subsequent warranties, for our services, and technical administration. Your data collected during online registration in the "MY E&P" customer portal will not be used for marketing purposes without your prior consent.

Your personal data will only be passed on or otherwise transmitted to third parties if this is necessary for the purpose of contract fulfilment or if you have given your prior consent.

Data processing for the purpose of fulfilling the contract or for carrying out pre-contractual measures (Art. 6 (1) (b) GDPR)

  •  The processing of your personal data takes place primarily for the purposes of the appropriate implementation of the contractual relationship.

 

Data processing based on your consent (Art. 6 (1) (a) GDPR)

  • If we have obtained consent from you to process personal data for specific purposes (e.g. quotation), the processing is lawful on that basis. Consent given can be revoked at any time. The revocation of consent is for the future and does not affect the lawfulness of the data processed up to the revocation.

 

Data processing for legitimate interest (Art. 6 (1) (f) GDPR)

  • We process your data beyond the actual fulfilment of the contract where this is necessary in order to protect our legitimate interests or the legitimate interests of third parties. For example:
    • Assertion of legal claims and defence in legal disputes;
    • Ensuring IT security and IT operations;
    • Prevention and investigation of criminal offences;
    • Measures for business management and further development of services and products.

Insofar as you have given us consent to process personal data for specific purposes, the lawfulness of this processing is based on your consent. Consent given can be revoked at any time.

The “LevelM Pro” product is protected by product activation, which requires online registration in the MY E&P customer portal by the retailer before the product is used. In order to establish the functionality of the product, the retailer must therefore register in AL-KO's online portal via https://www.ep-hydraulics.com/de_de/my-ep, create a user account (hereinafter referred to as “registration”) and add the product to their profile. AL-KO thereby records the following data: e-mail address, MFPU number, vehicle identification number (VIN) and product serial number. Details of the privacy policy will be made available to the retailer as part of the registration process and acknowledged by the retailer. Details of the registration process are described in the operating instructions.  Once the data has been entered in full and registration has been completed correctly, the retailer will receive a code that they can enter on the product's touch display to activate the product.

Private customers have the option of registering in the "MY E&P" online customer portal and creating a user account (hereinafter referred to as "registration"). After registration, the customer receives access to the product registration, which gives them access to software updates. AL-KO thereby records the following data: first and last name, address, e-mail address and vehicle identification number (VIN). Details of the privacy policy will be made available to the customer as part of the registration process and acknowledged by the customer. The product registration serves in particular the purposes of enabling rapid contact with the customer for product safety reasons as well as providing information about necessary software updates for the product.

AL-KO provides the customer with software updates for the product at irregular intervals via their user account created at registration. The customer also receives notifications of security-relevant updates to the e-mail address provided during registration.  

Registration leads to the processing of the customer's personal data. This data processing is carried out in accordance with data protection regulations. Details can be found in the attached privacy policy.

We make every effort to ensure the security of your data within the framework of the applicable data protection laws and technical possibilities.

We encrypt your personal data during the registration process. We use the SSL (Secure Socket Layer) coding system, but we would like to point out that data transmission on the Internet (e.g. when communicating by e-mail) can present security vulnerabilities. It is not possible to completely protect data from third-party access.

To secure your data, we maintain technical and organisational security measures that we constantly adapt to the state of the art. We also do not guarantee that our content will be available at all times; disruptions, interruptions or failures cannot be ruled out. The servers we use are carefully backed up on a regular basis.

Where necessary, we process and store your personal data for the duration of our business relationship including, for example, also the conclusion of a contract. In addition, we are subject to various storage and documentation obligations dictated i.a. by the German Commercial Code (HGB) or the German Fiscal Code (AO). The storage or documentation periods specified therein are between two and ten years. Finally, the storage duration is also dictated by the statutory periods of limitation which, for example, according to §§ 195 ff. of the German Civil Code (BGB) is generally three years, but in certain cases can also be up to thirty years. Retention period of the personal data processed by us

Information on online presences in social media in accordance with Article 13 GDPR

We maintain online presences within social networks and platforms in order to be able to communicate with the customers, interested parties and users active there and to inform them about our services there.

We would like to point out that user data may be processed outside the European Union. This can result in risks for users because, for example, it could make it more difficult to enforce users' rights. Furthermore, user data is usually processed for market research and advertising purposes. For example, usage profiles can be created from the usage behaviour and resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside the platforms that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on the users' computers, in which the usage behaviour and interests of the users are stored. Furthermore, the usage profiles can also store data independently of the devices used by the users.

The processing of users' personal data is based on our legitimate interests in providing users with effective information and communicating with users in accordance with Art. 6 (1) (f) GDPR.

Also in the case of requests for information and the assertion of user rights, we point out that these can be asserted most effectively with the providers. We process personal data that we have received from you or from publicly accessible sources in the course of our business relationship.


Scope and purpose of processing 

We only process your data if the processing is permitted by law or if we have received your consent to process the data. Relevant personal data are names, address data and telecommunication data. In addition, this may also include enquiry, offer and order data, data from the fulfilment of our contractual obligation, documentation data as well as other data comparable with the categories mentioned.
This data is collected:

  • in order to be able to identify you as our supplier,
  • in order to carry out the contractual relationship,
  • in order to correspond with you,
  • in order to process any liability claims that may exist as well as to assert any claims against you.

 

The legal basis for processing

  • Data processing for the purpose of fulfilling the contract or for carrying out pre-contractual measures (Art. 6 (1) (b) GDPR)
    The processing of your personal data takes place primarily for the purposes of the appropriate implementation of the contractual relationship.
  • Data processing based on your consent (Art. 6 (1) (a) GDPR)
    If we have obtained consent from you to process personal data for specific purposes (e.g. quotation), the processing is lawful on that basis. Consent given can be revoked at any time. This also applies to the revocation of declarations of consent that you gave us before the GDPR came into force on 25 May 2018. The revocation of consent is for the future and does not affect the lawfulness of the data processed until the revocation.
  • Data processing for legitimate interest (Art. 6 (1) (f) GDPR)
    We process your data in a permissible manner to protect our legitimate interests. This includes using your personal data to:
    • To assert legal claims and to defend legal disputes
    • To investigate or prevent criminal offences

If we wish to process your personal data for a purpose not previously mentioned, we will inform you of this beforehand within the framework of the legal provisions. 
 

Inquiry by email, telephone or fax

If you contact us by email, telephone or fax, your enquiry including all resulting personal data (name, enquiry, etc.) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent. The processing of this data is based on Art. 6 (1) (b) GDPR, insofar as your request is related to the fulfilment of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 (1) (a).
 

Duration of data retention

We will store or retain your data for as long asit is required for our business purposes and beyond that in accordance with the statutory retention, documentation and limitation periods.
 

Recipient of the data 

At AL-KO Vehicle Technology, the departments and employees who have access to your personal data are those who need it to fulfil our contractual and legal obligations or to protect legitimate interests. Furthermore, service providers and vicarious agents employed by us may receive data for these purposes. We may only pass on information about you if this is required by law, if you have given your consent, if we are legally authorised to provide information or pass on information and/or if the processors commissioned by us guarantee compliance with confidentiality and the provisions of the Data Protection Regulation and the Federal Data Protection Act. Furthermore, data is also exchanged with affiliated companies of AL-KO Vehicle Technology in third countries.
If service providers in third countries are used, in addition to written instructions, they are required to comply with the level of data protection in the EU by agreeing to the EU standard contractual clauses. Corresponding contractual agreements exist with affiliated companies of AL-KO Vehicle Technology.

Scope, purpose and legal basis of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes in the context of job interviews, etc.), insofar as this is necessary to decide on the establishment of an employment relationship. 

The legal basis for this is § 26 BDSG-neu under German law (initiation of an employment relationship), Art. 6 (1) (b) GDPR (general contract initiation) and – if you have given your consent – Art. 6 (1) (a) GDPR. The consent can be revoked at any time. 
Your personal data will only be passed on within our company to persons who are involved in processing your application. If the application is successful, the data submitted by you will be processed on the basis of § 26 BDSG-neu and Art. 6 (1) (b) GDPR for the purpose of implementing the employment relationship in our data processing systems.
 

Duration of data retention

If we are unable to make you a job offer, you reject a job offer, withdraw your application, revoke your consent to data processing or request us to delete the data, the data you have submitted incl. If applicable, any remaining physical application documents will be stored for a maximum of 6 months and 7 days after the end of the application process (retention period) in order to be able to trace the details of the application process in case of discrepancies (Art. 6 (1) (f) GDPR).

If we find your profile interesting for other vacancies and would like to check further employment opportunities, we will write to you to ask whether you agree to be included in the pool of applicants. The same applies to speculative applications. In the event that you have agreed to further storage of your personal data, we will transfer your data to our applicant pool. There, the data is deleted after 12 months.

After expiry of the retention period, the data will be deleted unless there is a legal obligation to retain the data or another legal reason for further storage. If it is evident that it will be necessary to retain your data after the retention period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted once it has become irrelevant. Other statutory retention obligations remain unaffected.


Recipients of personal data

We use the online portal of d.vinci HR-Systems GmbH to register your application data. This company acts as a service provider for us and may also obtain knowledge of your personal data in connection with the maintenance and care of the systems. We have concluded a so-called order processing contract with this provider, which ensures that the data processing is carried out in a permissible manner.
Your applicant data will be viewed by the HR department after receipt of your application. Suitable applications are then forwarded internally to the department heads for the respective open position. Then the further procedure is coordinated. In principle, only those persons in the company have access to your data who need this for the proper running of our application process.
 

Transfer of data to third parties

Personal data will not be transferred by us to third parties as part of the application process.
